Description

Leigh Academies Trust is seeking to establish a single-supplier Framework Agreement for the provision of Energy Consultancy Services. The Framework will be available for use by the Contracting Authority and a wide range of Authorised Users across the education sector and wider public sector. The Framework will cover, but is not limited to, the following services: Energy procurement and purchasing support, including the management of energy contracts and broker services Energy auditing, monitoring, and reporting Budget setting, bill validation, and invoice management Carbon and sustainability advisory services Regulatory compliance advice, including support with ESOS, SECR, and other legislative obligations Energy strategy development and implementation support Utility management and data analysis Support with renewable energy and decarbonisation initiatives The Framework will be established for a period of four years and will be awarded to a single supplier under an Open Procedure in accordance with the Procurement Act 2023 and associated Procurement Regulations 2024. Call-off contracts will be awarded via direct award without further competition. The Framework will be managed by Pretium Frameworks Limited as Framework Manager. Authorised Users will access the Framework via an Access Agreement. Call-off contracts awarded under this framework may be extended beyond the initial contract term. The maximum duration of any individual call-off contract, including any extensions, shall not exceed 10 years. The Authorised Users may exercise the right to extend at their sole discretion, provided that written notice is given to the Framework Provider no later than 1 month prior to the expiry of the then-current term. Extensions are subject to satisfactory performance, continued need, and budgetary approval. The Framework will be available to organisations throughout the UK, if the User is permitted to do so and not confined by geography. This Framework will be open to but not limited to: • any entity within the same group of companies as Leigh Academies Trust from time to time (a “Leigh Academy”) • any entity or joint venture company that Leigh Academies Trust or any other Leigh Academies Trust Member holds an interest in from time to time (a “Leigh Academies Trust JV”) • any Social Housing Provider in the United Kingdom (excluding Leigh Academies Trust, Leigh Academies Trust Members and Leigh Academies Trust JVs) • any national, regional or local health authority, including NHS Trusts • any educational establishment, including but not limited to primary and secondary schools, further and higher education institutions, academies and free schools • any other “contracting authority” in the UK as defined in the Procurement Act 2023; and • any supply chain member of Leigh Academies Trust or of any of the above organisations • and, in the case of the organisations listed in limbs (iii), (iv), (v), (vi) and (vii) above, who has entered into an Access Agreement with Leigh Academies Trust

Further information about fees

The cost of operating and administering the framework for Users will be recovered by Pretium through a management fee, based on the value of all sales procured through the Framework. This payment will be made by the framework supplier awarded the Framework and as such there will be no additional costs to any organisation for accessing the Framework. This management fee is deemed to be included in the rates and prices tendered. Service: Energy Procurement (% recovered from Consultants p/pkwh rate). Fee %: 15% Service: All other Consultancy services as detailed in the scope of works and included in rates. Fee %: 3.50%

Framework operation description

The Framework is established by Leigh Academies Trust as the Contracting Authority and is managed and administered on an ongoing basis by Pretium Frameworks Limited, acting as Framework Manager and Agent. The Framework consists of a single lot awarded to a single supplier. Call-off contracts are awarded by Award Without Further Competition, allowing Authorised Users to instruct the Framework Supplier directly without any further tender process. Authorised Users access the Framework by entering into an Access Agreement with Leigh Academies Trust and Pretium Frameworks. The Framework is open to organisations throughout the UK including educational establishments, social housing providers, NHS and health authorities, and any other contracting authority as defined under the Procurement Act 2023. Pretium Frameworks is responsible for overseeing strategic performance of the Framework Supplier, coordinating the signing of Access Agreements, and administering awards without further competition. Individual Authorised Users are responsible for administering their own call-off contracts and monitoring operational performance at contract level. The cost of administering the Framework is recovered by Pretium through a management fee based on the value of all sales procured through the Framework. This fee is paid by the Framework Supplier and is included within the rates tendered in the Price Schedule, meaning there are no additional costs to Authorised Users for accessing the Framework.
